Art. 1 – Withdrawal<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

Pursuant to Art. 64 et seq. of Legislative Decree No. 206\/2005, if the Customer is a consumer, they have the right to cancel the purchase contract for any reason, without penalty, within 14 days from the date of receipt of the products, subject to the provisions set forth in the section below titled \u201cWarranty and Legal Conformity.\u201d MC will refund the Customer the amount already paid, from which will be deducted the costs incurred for shipping, insurance, any online payment gateway fees, and any other costs incurred for the specific order (duties and other incidental costs). The total amount, net of the aforementioned costs, will be refunded as soon as possible and in any case within 30 days from the date of receipt of the notice of withdrawal, upon receipt of the goods subject to withdrawal, via bank transfer or through an Online Gift Card, redeemable only on the Website. It is therefore the Customer\u2019s responsibility to make a choice and, in the first case, to promptly provide the bank account details to which the refund should be sent (IBAN of the invoice holder).The right of withdrawal provided for by the Consumer Code applies exclusively to purchases made by consumers for purposes unrelated to their entrepreneurial, commercial, artisanal, or professional activities. Purchases made as part of a professional or business activity are therefore not covered by the right of withdrawal provided for consumers, unless otherwise expressly agreed upon with Martcom.<\/li>
To exercise this right, the Customer must send a request to cancel the order via email to: store@martcom.eu<\/a>. Once MC receives this request, it will send the Customer the corresponding Withdrawal Form, which must be completed in its entirety. The Customer must specify, at their discretion, whether to receive the refund via bank transfer (providing their account information) or via an online gift card to be used on the website. This Withdrawal Form must be sent by certified mail with return receipt requested and forwarded via email within 14 days of the date of receipt of the Products to:

The right of withdrawal is subject to the following mandatory conditions:\n

This right applies to the product purchased in its entirety; you may not exercise the right of withdrawal with respect to only part of the purchased product (e.g., accessories, included software, etc.);<\/li>\n \t
This right does not apply to audiovisual products or sealed computer software (including software bundled with hardware) once they have been opened;<\/li>\n \t
The purchased product must be in good condition and returned in its original packaging, complete with all parts (including packaging and any documentation and accessories: manuals, cables, etc.);<\/li>\n \t
The product for which the right of withdrawal is exercised must be returned in its normal condition. Used products that show signs of damage or dirt will not be accepted;<\/li>\n \t
The product must bear the same serial number as the one listed on the MC sales invoice;<\/li>\n \t
The shipping costs and risks associated with returning the item are the responsibility of the Customer;<\/li>\n \t
MC assumes no liability whatsoever for damage to, or theft or loss of, goods returned via uninsured shipments.<\/li>\n<\/ul>\n<\/li>\n \t
MC will refund the Customer the amount already paid, less the costs incurred for shipping, insurance, any online payment portal fees, and any other costs incurred in connection with the specific order. The total amount, net of the aforementioned costs, will be refunded within 30 days of the date of receipt of the notice of withdrawal, upon receipt of the merchandise, via bank transfer or an online gift card that can only be used on the Website.<\/li>\n \t
The right of withdrawal is forfeited entirely if the essential condition of the goods’ integrity (packaging and\/or its contents) is not met, in cases where MC determines that the original packaging is missing, integral components are absent, the goods are damaged for reasons other than shipping, or the goods are soiled due to use.<\/li>\n<\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

If the Customer entered into the contract as a consumer, MC is liable for any \u201clacks of conformity\u201d existing at the time of delivery of the goods, as provided for in Articles 129 et seq. of the Consumer Code.<\/li>
MC\u2019s liability is limited solely to \u201clacks of conformity\u201d and does not cover any defects that may arise, for example, due to improper use by the consumer or third parties, nor does it cover defects inherent in production and manufacturing, for which the manufacturer\u2019s direct liability remains unaffected.<\/li>
In the event of a lack of conformity, the consumer shall be entitled to have the Products brought into conformity at no cost, or to terminate the contract with respect to the disputed goods, subject to verification by MC.<\/li>
If the Customer discovers a defect, they must report it by email to store@martcom.eu<\/a>, providing proof of purchase and any relevant documentation. MC will send you the corresponding Complaint Form, which must be completed and returned within 5 days of receipt.<\/li>

Once the process is complete, you will receive a confirmation of receipt on a durable medium, including the contents of the declaration and the date and time of submission.
